These terms govern your use of the Fourway Global Advisory website and, where you engage us, the consultancy services we provide. By using this site you accept these terms. Where you engage us for a specific matter, a separate written engagement letter will apply and will prevail over these terms to the extent of any inconsistency.
Nature of our services
We are a private visa consultancy. We are not a government department, we are not affiliated with any immigration authority, and we cannot influence, expedite or guarantee the outcome of any application. Decisions rest solely with the relevant immigration authority or embassy.
Our services consist of assessment, advice on suitable routes, preparation of documentation, lodgement of applications on your instruction, and follow-through to decision.
Engagement and fees
- The initial assessment consultation is provided free of charge and does not create a client relationship
- A client relationship begins only when a written engagement letter is signed by both parties
- Professional fees are fixed and stated in the engagement letter before any chargeable work begins
- Government charges, skills assessment fees, English test fees, medical examinations, police clearances, translation and attestation costs are payable by you directly to those bodies and are itemised separately
- Professional fees may be structured in stages tied to defined milestones
Your responsibilities
The accuracy of your application depends on the accuracy of what you give us. You are responsible for:
- Providing complete, truthful and accurate information and documents
- Disclosing all previous visa applications, refusals, cancellations and immigration breaches
- Disclosing any criminal history, health condition or circumstance that may affect character or health requirements
- Responding to our requests for information within the timeframes we specify
- Notifying us promptly of any change in your circumstances during an application
- Reviewing your application before it is lodged and confirming its accuracy
False or misleading information
We will not lodge an application we know or suspect to contain false or misleading information, or fabricated documents. If we discover such material after engagement, we will cease work immediately, and fees for work already performed remain payable. Providing false information to an immigration authority can result in refusal, visa cancellation, multi-year entry bans and criminal liability.
No guarantee of outcome
We do not and cannot guarantee that any application will be approved, or that it will be decided within any particular timeframe. Any timeframes we give are estimates based on published processing times and our experience, and are not commitments. Immigration policy, occupation lists, points settings and processing priorities change without notice and may affect your application while it is in progress.
Refunds
- Government and third-party fees are set by those bodies and are not refundable by us
- Professional fees for work already performed are not refundable, including where an application is refused
- Where an application is refused as a result of a demonstrable error on our part, we will reprepare and re-lodge the application at no further professional fee
- Where you terminate the engagement before completion, fees are payable for the stages completed to that point
Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with our services is limited to the professional fees you have paid us for the matter concerned. We are not liable for indirect or consequential loss, including loss of income, loss of opportunity, travel costs, accommodation costs or tuition deposits.
Nothing in these terms excludes any liability that cannot lawfully be excluded.
